Know Your Rights Before You Act

In my practice before the Lucknow Bench of the High Court, I often meet people who approach the court only after their rights have already been compromised. By then, documents are missing, limitation has nearly run out, and the other side has already acted upon an illegal order. I firmly believe that legal awareness is not a luxury—it is the first line of defence for every citizen.

Our Constitution does not leave the individual helpless against the State. Fundamental Rights—especially equality before law under Article 14, freedoms under Article 19, and the right to life and personal liberty under Article 21—are living protections. When a government department, local body, police authority, or any instrumentality of the State acts arbitrarily, discriminates, or denies a fair hearing, the citizen is not without remedy.

A writ petition before the High Court can be a powerful and timely remedy. I have seen how a well-prepared petition can stay an illegal demolition, secure release from unlawful custody, restore a service benefit wrongly withheld, or compel an authority to perform a duty it is legally bound to discharge. The strength of such a case does not lie in long affidavits alone; it lies in clear facts, relevant documents, and precise legal grounds.

My advice is simple: do not wait until the damage is irreversible. If an order has been passed against you without notice, if your representation is ignored for months, or if your liberty or livelihood is under threat, consult a counsel promptly. Early advice often prevents litigation—or at least places you on the right footing when litigation becomes necessary.

Know your rights. Preserve your papers. And act in time. That is how the Constitution works in real life—not merely as text in a book, but as protection you can invoke when you need it most.
